Affiliate Program Terms

1. Who these terms cover

These Affiliate Program Terms apply when you join Queek's affiliate program or promote Queek using an affiliate link or code. The program is free to join and open to people around the world, including creators, developers, agencies, freelancers and merchants. You do not need a Queek store to join. Country and payout availability is shown in your dashboard.

You may not participate if a law, sanctions restriction, or payout-provider rule prevents Queek from serving or paying you. We may ask for information needed to confirm your eligibility or verify a payout account.

2. Key terms

“Affiliate” means a person or organisation enrolled in the program. “Referred merchant” means a business whose account is attributed to your affiliate link or code. “Commission” means the amount earned under these terms after a referred merchant pays an eligible subscription invoice. “Dashboard” means the Queek account area where program status, referral events, commissions and payout information are shown.

3. Joining and accepting terms

You must provide accurate information, keep it current and follow the instructions in your dashboard. Joining does not create a Queek store or make you a Queek merchant. Your participation starts when Queek records your acceptance of the current terms version.

Queek may decline or pause enrollment where eligibility, legal, security or payout requirements are not met. We will request only information reasonably needed to administer the program and verify payouts.

4. Referrals and attribution

A referral is eligible when Queek records your affiliate link or code with a new merchant account before that merchant's first paid subscription invoice. On Queek's site, the most recently captured code is kept in the active browser session and forwarded with signup. Signups, free trials and unpaid invoices do not earn commission. A merchant's own account, or an account controlled by you, is not an eligible referral.

Queek's referral and payment records determine attribution. Your dashboard will show the referral and payment events used to calculate commission. You may dispute an attribution or calculation by contacting Queek within 30 days after the relevant event appears in your dashboard.

5. Commission rates and term

For a standard referral under version 1.1, you earn 20% of the referred merchant's first paid subscription payment and 15% of each paid renewal for up to 36 months from that first paid subscription payment. Commission is calculated on the subscription amount actually paid, in the invoice currency, excluding unpaid, reversed or refunded amounts.

A commission is earned only after Queek receives payment for the eligible invoice. Signups and trials alone never earn commission. Queek may offer custom terms to established partners in a separate written arrangement. If custom terms conflict with these terms, the written arrangement controls for the referrals it identifies.

6. Validation, holds and adjustments

Each commission is held for 30 days after the qualifying payment to allow payment validation. After the hold, eligible commissions are included in the monthly payout cycle, subject to the payout minimum and verified payout details.

Queek may delay or reverse a commission when the underlying payment is refunded, charged back, duplicated, made in error or connected to fraud or a breach of these terms. We will show an adjustment in your dashboard and offset an amount owed against future payouts first. Queek may pause payment while it reviews credible signs of fraud or a payment dispute.

7. Payouts, currencies and minimums

Payouts are made monthly to a verified bank or other payout account supported for your country. Country availability and the minimum payout for each currency are shown in your dashboard (shown in your dashboard). You are responsible for keeping your payout details accurate. Queek may delay a payout while details are incomplete, a transfer is under review, or a legal or provider restriction applies.

Commissions are recorded in the referred merchant's invoice currency. If a payout must be converted, Queek will show the conversion and any applicable payout fees in the dashboard before payment. Payout timing may depend on the receiving institution or payment provider.

8. Taxes

You are responsible for determining and paying taxes that apply to your commissions. Queek may collect the tax information reasonably required for payment and may withhold or report amounts when the law applying to the paying entity requires it. For example, Nigerian withholding tax may apply to a payment where Nigerian law requires it. Any withholding will be reflected in the payout record.

9. Promotion rules

Promote Queek honestly and lawfully. Do not refer yourself or an account you control, bid on “Queek” or Queek brand terms in paid search, send spam, use misleading claims, manipulate referral tracking, or misrepresent a product, price, feature or relationship with Queek.

If a post or recommendation is paid or sponsored, clearly disclose that relationship wherever you share it. Follow advertising, consumer-protection, privacy and platform rules that apply to your audience and location. Queek may ask you to correct or remove promotion that does not meet these rules.

10. Queek name and materials

While you participate, Queek grants you a limited, non-exclusive, revocable permission to use Queek names and materials that Queek has approved for affiliate promotion, following any brand instructions we provide. This permission does not transfer ownership or allow you to register a confusingly similar name, imply Queek endorses you, or alter Queek materials in a misleading way.

When your participation ends or Queek asks, stop using the materials and remove them from places you control within three business days.

11. Privacy and referral information

Use referral information only to administer your participation and communicate appropriately with people you refer. Do not collect or share personal information through your promotion in a way that violates privacy law. Queek limits dashboard referral details to information needed to explain attribution and commission, such as referral status and payment events.

Each party must comply with privacy and data-protection laws that apply to it. Queek's Privacy Policy describes how Queek handles personal information. You must have a lawful basis for information you collect independently and honour applicable access, deletion and cross-border transfer requirements.

12. Confidential information

Keep non-public program, referral and payout information confidential and use it only to participate in the program. This does not cover information that is public through no breach, was already lawfully known to you, or was independently developed. You may disclose confidential information when the law requires it; where allowed, give Queek advance notice. This duty continues for two years after your participation ends.

13. Relationship between the parties

You participate as an independent contractor. These terms do not create employment, an agency, a partnership, a joint venture or an exclusive relationship. You cannot make commitments on Queek's behalf, and you are not entitled to employee benefits from Queek.

14. Suspension, termination and unpaid balances

Queek may suspend your participation or delay payouts while investigating suspected fraud, a serious breach, a legal restriction or a risk to merchants or the program. Where practical, we will explain the issue and give you a reasonable chance to respond or correct a minor breach. Queek may terminate immediately for fraud or an urgent legal or security risk, and may terminate for another material breach after notice and a reasonable chance to cure where practical. Queek may also end your participation without cause on 30 days' notice, or end the program on notice.

If participation ends without cause, valid commissions earned through the end date remain payable after the applicable hold and payout checks. Unpaid commissions may be forfeited for fraud or a material breach. A balance below the applicable payout minimum may expire after 24 months without account activity only after Queek sends a reminder and a reasonable opportunity to claim it.

15. Warranties, liability and indemnity

The program is provided without a promise that it will be uninterrupted or available in every country. To the extent the law allows, Queek's total liability arising from the program is limited to commissions paid to you in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot lawfully be limited.

You are responsible for your promotion and for following these terms. To the extent the law allows, you will cover Queek's reasonable losses and costs arising from your unlawful promotion, infringement of another person's rights, material breach of these terms or failure to meet your tax obligations.

16. Changes to these terms

Queek publishes numbered versions of these terms and may update the program or its rates. We will give at least 30 days' notice before a new version takes effect and ask you to accept each version before making new referrals under it. You may stop participating before it takes effect.

A referral keeps the terms version in effect when that referral was recorded. A later version applies only to referrals recorded on or after its effective date. A change does not remove a commission already earned; earned amounts remain subject to the validation, adjustment and payout rules in effect for them.

17. Sanctions, disputes and governing law

You must comply with sanctions and export-control rules that apply to you and the program, including applicable United Nations, United States, European Union and United Kingdom restrictions. Queek may decline enrollment, pause activity or hold a payout where a sanctions restriction, law or payout provider prevents it. We will provide an explanation and a way to raise a question where doing so is permitted.

Contact Queek within 30 days after a referral, payment or payout event appears in your dashboard if you believe it is wrong. Queek will review the records and respond. These terms are governed by [GOVERNING LAW — COUNSEL TO COMPLETE].
